MUNICIPAL INITIATIVES

# OF SIGNATURES NEEDED

For Next Regular Election -- 10% of the registered voters in the City as of the Report of Registration to the SOS filed by the ROV prior to the Notice of Intention being published need to sign petition. (EC Section 9215) For a Special Election -- The City may call a special election if 15% of the registered voters in the City as of the Report of Registration submitted to the SOS prior to the Notice of Intention being published sign the petition. (EC Section 9214)

# OF DAYS ALLOWED TO CIRCULATE PETITION

180 days from date of receipt of Title and Summary. (EC Section 9208)

CITY REQUEST COUNTY TO VERIFY SIGNATURES

City needs to put request in writing to the ROV. City must include in the letter: The name of the petition; starting and ending dates of circulation; approximate number of sections; approximate number of signatures turned-in; number of valid signatures necessary; type of signature count requested – 100% or random; address where invoice should be mailed; and any other special instructions.

COST FOR COUNTY TO VERIFY SIGNATURES

$3.40 per signature.

WITHDRAWAL REQUESTS

These requests are filed with the City Clerk no later than the day before petitions are filed with the City Clerk. (EC Section 9602)

RANDOM % OF SIGNATURES TO BE VERIFIED

If more than 500 signatures on petition, random is 3% (EC Sections 9115, 9211)

DEADLINE FOR SIGNATURE VERIFICATION

Within 30 working days, excluding Saturdays, Sundays, and holidays from the date the petition was filed; if after a random is completed, all signatures must be verified, need to do so within 60 working days, excluding Saturdays, Sundays, and holidays from the date the petition was filed. (EC Sections 9114, 9115, 9211)

WILL PETITIONS BE RETURNED TO CITY?

Yes, the City needs to pick them up after the ROV prepares the certificate showing the results of the signature verification.

CONSOLIDATION WITH A STATEWIDE ELECTION

City must file a resolution of its governing board with the Board of Supervisors and a copy with the ROV, requesting consolidation, and setting forth the exact form of any question, proposition, or office to be voted upon at the election, as it is to appear on the ballot. This resolution must be filed at least 88 days prior to the election (EC Section 10403).

SPECIAL ELECTION

City should notify ROV as soon as possible with the date of the special election. However, the exact form of any question proposition, or office to be voted upon at the election shall be filed with the ROV by the 88 th day before the election. (EC Sections 1002, 1301)

85 days before the election.

COST TO CONSOLIDATE

Comparing the costs of a stand-alone and consolidation, the cost is approximately double to conduct a stand-alone election rather than a consolidated one. General Elections typically cost less per jurisdiction for consolidation than Primary Elections. For more information, call the ROV Accounting Office (714) 567-5107.

PUBLIC REVIEW PERIOD

City public review period does not need to coincide with County public review period; but, the City must be aware of the County’s printing deadline to ensure info will be printed in sample ballot. If due to litigation regarding information in the sample ballot, the City cannot adhere to the County’s deadline, the City will need to prepare a separate sample ballot for their voters.

PURCHASING INFORMATION

$103 for CD not containing voter history; $115 for CD containing voter history; street indexes cost $.50 per 1,000 registered voters. A Secretary of State form is required to be completed prior to receiving any computer products.

TRANSLATIONS

Measures circulated by the public need to be translated by the proponents of the measure. Court certified translators must be used.
